In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e-mail, billing address, and/or phone number provided at the time the order was made.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.

You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.
We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.
We have an "Arrive Alive" guarantee. We guarantee your ordered number of birds arrive healthy and true to breed. Please contact us immediately (within 24 hours of the arrival of your chicks) should any losses or variances to your order occur, so we may replace your birds or reimburse you. Reshipments are subject to availability and minimum shipping requirements. If eligible, we will reship only once. Reimbursements are limited to the cost of the birds and will not include shipping charges.
Chickens For Backyards will not knowingly ship any birds or products in violation of the Animal Welfare Act or any other Federal, State, or Local laws or ordinances.
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Chickens For Backyards, its affiliates or licensors and are protected by U.S. and foreign patent, copyright and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent.
You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement.

We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you decide to leave the Services to access these materials or third party sites, you do so at your own risk.
Chickens For Backyards is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Chickens For Backyards. Shopify is not responsible for any aspect of any sales between you and Chickens For Backyards, including any injury, damage, or loss resulting from purchased products and services.
All personal information we collect through the Services is subject to our Privacy Policy. Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you.
If you submit any ideas, suggestions, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use it. You also represent that you have the rights to do so and that the content complies with our policies and does not infringe on the rights of others.
Occasionally there may be information on or in the Services that contain typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any such information and cancel orders as needed.
You agree not to use the Services for any unlawful, harmful, or prohibited purpose including, but not limited to, violating laws, infringing intellectual property, harassing others, or attempting to gain unauthorized access to any systems.
We may terminate or suspend your access to the Services at any time for any reason. Provisions that by their nature should survive termination will continue to apply.
You can cancel on any day (business hours Mon–Fri) except 24 hours before and on your ship day. All orders are subject to a $20.00 restocking fee. All refunds take 3–5 business days to be fully processed. If you do not see the money back on your card after 5 business days, please contact us so that we can get the issue fixed.
Customers may request modifications to their pending orders by adding items only—removing or deducting any products from an existing order is not permitted. To add items, customers can log into their account on our website and update the order directly. All approved order changes will incur a $20 administration and processing fee to cover additional handling and services. This fee will be applied automatically at the time the change is processed. We appreciate your understanding, as this policy helps ensure efficient and accurate order fulfillment.
We have a 90% sexing guarantee. For errors that exceed the guarantee, we will refund the difference between pullet and cockerel prices. Sexing errors must be reported when chicks are not more than 10 weeks old.
No credit will be issued for any reason after the birds are 18 weeks old.
To give your chicks the best possible start, please carefully review our care instructions well in advance so you fully understand the preparation required. A printed copy of these instructions will be included with your shipment, and we strongly recommend rereading them upon delivery to ensure you are following the proper steps.
You must be available and flexible on your scheduled delivery date to pick up the chicks from the post office promptly upon arrival—delays at the post office can be harmful. Have your brooder fully prepared and preheated before the chicks arrive, and plan to be present for at least the first 24 hours to closely monitor their adjustment, regulate brooder temperature, and confirm they are actively eating and drinking.
Mark your calendar and watch for the shipping notification email so you are ready the moment the chicks ship. Immediate pickup and transfer to a warm, prepared brooder is essential, as chicks need to warm up and begin eating and drinking right away.
If you notice any unsafe delivery conditions, please report them immediately as outlined in our Shipment Guarantee section of these Terms of Service. Following these steps is your responsibility and is critical to the health and survival of your chicks.
THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.
TO THE FULLEST EXTENT PROVIDED BY LAW, CHICKENS FOR BACKYARDS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS.
You agree to indemnify and hold harmless Chickens For Backyards and its partners, affiliates, and service providers against any claims arising out of your use of the Services or violation of these Terms.
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions shall remain in effect.
These Terms constitute the entire agreement between you and Chickens For Backyards regarding the Services and supersede any prior agreements.
You may not assign these Terms without our consent. We may assign these Terms without notice or consent.
These Terms are governed by the laws of the jurisdiction where Chickens For Backyards is headquartered. You consent to jurisdiction in such courts.
